A. ACCEPTANCE OF TERMS
Your access to the Family Care Pharmacy (“Family Care Pharmacy”) mobile application and websites, including co-branded Drugstore2door-affiliate websites, (collectively, the “Family Care Pharmacy Digital Services”) is subject to the Family Care Pharmacy Privacy Policy, HIPAA Privacy, and these Terms of Use.
IF YOU DO NOT AGREE WITH ANY OF THESE TERMS, YOU ARE PROHIBITED FROM USING THE Family Care Pharmacy DIGITAL SERVICES. BY USING THE Family Care Pharmacy DIGITAL SERVICES, YOU AGREE TO THESE TERMS OF USE.
These Terms also govern your participation in any SMS or mobile communications programs offered by Family Care Pharmacy. If you opt in to receive text messages from us, the Mobile Terms & Privacy Summary governs such messaging.
B. MODIFICATION OF TERMS OF USE
The mobile application and this website are owned and operated by AZ RX Media, LLC. AZ RX Media, LLC reserves the right to change, modify, add or remove portions of these Terms of Use at any time and in its sole discretion. Such modifications and additional terms and conditions will be effective immediately and incorporated into these Terms. You are responsible for reviewing and becoming familiar with any such modifications. Your continued use of Family Care Pharmacy Digital Services following the posting of any changes to these Terms of Use means you accept and agree to such changes. As long as you comply with these Terms of Use, Family Care Pharmacy grants you a personal, non-exclusive, non-transferable, limited privilege to access and use Family Care Pharmacy Digital Services.

B. ACCOUNTS, PASSWORDS & SECURITY
Certain information or services offered on or through the Family Care Pharmacy Digital Services may require you to create an account (including setting up a User ID and password). You are responsible for maintaining the confidentiality of the information you hold for your account, including your password, and for all activities that occur in connection with your password or account. You agree to immediately notify us of any unauthorized use of either your password or account or any other breach of security. You further agree that you will not permit others, including those whose accounts have been terminated, to access the Family Care Pharmacy Digital Services using your account or User ID. Family Care Pharmacy cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.
For your account, you agree to provide true, accurate, current and complete information about yourself. It is your responsibility to maintain and promptly update this account information to keep it true, accurate, current and complete. If you provide any information that is fraudulent, untrue, inaccurate, incomplete or not current, or we have reasonable grounds to suspect that such information is fraudulent, untrue, inaccurate, incomplete or not current, we reserve the right to suspend or terminate your account without notice and refuse any and all current and future use of the Family Care Pharmacy Digital Services. Because any termination of your access to the Family Care Pharmacy Digital Services may be affected without prior notice, you acknowledge and agree that we may immediately deactivate or delete your account and all related information and files in your account and bar any further access to such files or the Family Care Pharmacy Digital Services. Furthermore, you agree that we shall not be liable to you or any third party for any termination of your access to your account or the Family Care Pharmacy Digital Services.
C. INFORMATION COLLECTED
Family Care Pharmacy may collect various types of information from website visitors. Family Care Pharmacy will collect transactional information from companies that exchange products through the Family Care Pharmacy Digital Services. The information collected may include shipping information and credit card details. The Family Care Pharmacy web server may also collects general data pertaining to every website visitor, including the IP address, the domain name, the web page, the length of time spent on the website, and the pages accessed while visiting the website. D. CREDIT CARD PAYMENTS & INFORMATION
Family Care Pharmacy uses BlueSnap, a third-party global payments company that provides software services for processing online payments, to accept and process credit card, debit card, and other types of payments (collectively, “Cards”) from Family Care Pharmacy users who wish to use the Family Care Pharmacy Digital Services. BlueSnap’s card processing service supports US-issued card and most non-US issued cards with a Visa, MasterCard, Discover, JCB, or American Express logo (collectively “the Card Networks”), including credit, debit, and pre-paid cards. By agreeing to these Terms & Conditions or by using the Family Care Pharmacy Digital Services, you also expressly agree to the BlueSnap Terms & Conditions, available online at https://home.bluesnap.com/terms-and-conditions/, as the same may be modified by BlueSnap from time to time. Neither Family Care Pharmacy nor BlueSnap is a bank or a money services business (“MSB”), and neither Family Care Pharmacy nor BlueSnap offers banking or MSB services as defined by the United States Department of Treasury.
As a condition of Family Care Pharmacy enabling payment processing services through BlueSnap, you agree to provide Family Care Pharmacy accurate and complete information about you, and you authorize Family Care Pharmacy to share it and transaction information related to your use of the payment processing services provided by BlueSnap. By using the Family Care Pharmacy Digital Services, you authorize Family Care Pharmacy and BlueSnap to charge you, through the payment method you select, the amount specified for each transaction associated with your Account. YOU ARE RESPONSIBLE FOR THE TIMELY PAYMENT OF ALL FEES AND FOR PROVIDING Family Care Pharmacy WITH A VALID PAYMENT METHOD FOR PAYMENT OF ALL FEES.
Your total price will include the price of the transaction, including any third party fees, plus any applicable tax. All transactions are final once completed. Prices may change at any time, and the Family Care Pharmacy Digital Services do not provide price protection or refunds in the event of a price reduction or promotional offering. Family Care Pharmacy reserves the right to close accounts and request alternative forms of payment if any information is fraudulently obtained or used on the Family Care Pharmacy Service.
You are solely responsible for all reversed or charged back transactions, regardless of the reason for, or timing of, the reversal or chargeback. We may add or remove one or more payment types or networks at any time. If we do so we will use reasonable efforts to provide notice of the removal.
E. SECURITY
Family Care Pharmacy places the utmost importance on protecting information transmitted via the Family Care Pharmacy Digital Services and will take security precautions to protect all such information; however, Family Care Pharmacy cannot guarantee that any electronic commerce is totally secure. Family Care Pharmacy will take measures to secure and protect all customer-specific information from loss, misuse, and alteration. By using the Family Care Pharmacy Digital Services, you also acknowledge and agree that Internet transmissions are never completely private or secure. You understand that any message or information you send through the Family Care Pharmacy Digital Services may be read or intercepted by others, even if there is a special notice that a particular transmission (for example, credit card information) is encrypted.
F. MOBILE COMMUNICATIONS & TEXT MESSAGING
By providing your mobile number to Family Care Pharmacy (“Family Care Pharmacy”) or its affiliates, you consent to receive recurring automated text messages (SMS/MMS) regarding order updates, refill reminders, and promotional offers. Message frequency may vary. Message and data rates may apply. You may opt out of the messaging service at any time by texting STOP to the number from which you received messages. You may also text HELP for assistance or contact us at [email protected].
Carriers are not liable for delayed or undelivered messages.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services (such as order fulfillment or customer service) is permitted. All other use-case categories exclude text-messaging originator opt-in data and consent; this information will not be shared with any third parties except aggregators and providers of the text-message services necessary to deliver our program.

Family Care Pharmacy DISCLAIMS ALL EXPRESS OR IMPLIED REPRESENTATIONS AND WARRANTIES REGARDING THE INFORMATION, SERVICES, PRODUCTS, MATERIALS AND ANY OTHER RESOURCES AVAILABLE ON OR ACCESSIBLE THROUGH THIS DIGITAL EXPERIENCE, INCLUDING ANY WARRANTIES OF ACCURACY, TITLE, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Family Care Pharmacy reserves the right to do any of the following, at any time, without notice: (i) to modify, suspend or terminate operation of or access to the Family Care Pharmacy Digital Services, or any portion of thereof, for any reason; (ii) to modify or change the Family Care Pharmacy Digital Services, or any portion of thereof, and any applicable policies or terms; and (iii) to interrupt the operation of the Family Care Pharmacy Digital Services, or any portion of thereof, as necessary to perform routine or non-routine maintenance, error correction or other changes.
B. LIMITATIONS OF LIABILITY
IN NO EVENT WILL Family Care Pharmacy BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, INCLUDING FOR LOSS OF PROFITS, GOOD WILL, USE, DATA OR OTHER INTANGIBLE LOSSES THAT RESULT FROM (i) THE USE OF OR INABILITY TO USE THE Family Care Pharmacy DIGITAL SERVICES, (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE Family Care Pharmacy DIGITAL SERVICES (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA ON THE Family Care Pharmacy DIGITAL SERVICES; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE Family Care Pharmacy DIGITAL SERVICES; OR (v) ANY OTHER MATTER RELATING TO THE DIGITAL EXPERIENCE, WHETHER IN CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, EVEN IF Family Care Pharmacy HAS BEEN ADVISED OF OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES. IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SUCH LIMITATION SHALL NOT BE APPLICABLE TO YOU.
If, notwithstanding the other provisions of these Terms of Use, Family Care Pharmacy is found to be liable to you, any liability on the part of Family Care Pharmacy will not exceed the fees paid by the user for the particular information or service provided. Family Care Pharmacy is not liable for the unauthorized use of our Content by any other web sites.
C. INDEMNIFICATION
You agree to indemnify and hold Family Care Pharmacy, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, parent companies, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against Family Care Pharmacy by any third party due to or arising out of or in connection to your violation of these Terms of Use, or with your use of the Digital Services.
D. GOVERNING LAW; DISPUTE RESOLUTION
If any part of these Terms of use is determined by a court of competent jurisdiction to be invalid or unenforceable, it will not affect any other provision of these Terms of Use, all of which remain in full force and effect. You agree that all matters, including all disputes, relating to your access to or use of Family Care Pharmacy information or services or of the Family Care Pharmacy Services, including its Contents, will be governed by the laws of the State of Texas without regard to its conflicts of laws provisions. You agree to the personal jurisdiction by and venue in the state and federal courts for Dallas County, Texas, and waive any objection to such jurisdiction or venue.
Any claim under these Terms of Use must be brought within one (1) year after the cause of action arises, or such claim or cause of action is barred. In the event of any controversy or dispute between Family Care Pharmacy and you arising out of or in connection with your access to or use of Family Care Pharmacy information or the Family Care Pharmacy Digital Services, including its Contents, the parties shall attempt, promptly and in good faith, to resolve any such dispute. If we are unable to resolve any such dispute within a reasonable time (not to exceed thirty (30) days), then either party may submit such controversy or dispute to mediation. If the dispute cannot be resolved through mediation, then the parties shall be free to pursue any right or remedy available to them under applicable law.
E. FOREIGN CORRUPT PRACTICES ACT
User acknowledges that it is not the agent of Family Care Pharmacy and represents and warrants that it has not, and covenants that it will not, pay anything of value to any government employee in connection with the resale of and products available through the Family Care Pharmacy Digital Services.
F. ENTIRE AGREEMENT; SEVERABILITY; MISCELLANEOUS
These Terms of Use, our Privacy Policy, and our HIPAA Privacy Notice constitute the entire agreement between you and Family Care Pharmacy and governs your use of the Family Care Pharmacy Digital Services. You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content, or third-party software. If any part of these Terms of Use is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect. Family Care Pharmacy’s failure to enforce any right or provisions in these Terms of Use will not constitute a waiver of such or any other provision. Family Care Pharmacy will not be responsible for failures to fulfill any obligations due to causes beyond its control. The section titles in the Terms are for convenience only and have no legal or contractual effect.
The Family Care Pharmacy Digital Services are operated by Family Care Pharmacy and its affiliates from its offices in the United States. You agree to comply with all local, state, federal, and national laws, statutes, ordinances, and regulations that apply to your use of the Family Care Pharmacy Digital Service. All transactions through the Family Care Pharmacy Digital Services are governed by Texas law, without giving effect to its conflict of law provisions. Your use of the Services may also be subject to other laws. Risk of loss and title for all electronically delivered transactions pass to the purchaser in Texas upon electronic transmission to the recipient. No Family Care Pharmacy employee or agent has the authority to vary these Terms of Use.
Family Care Pharmacy may notify you with respect to the Services by sending an email message to your account email address or a letter via postal mail to your account mailing address, or by a posting via the Family Care Pharmacy Digital Services. Notices shall become effective immediately.
Family Care Pharmacy reserves the right to take steps Family Care Pharmacy believes are reasonably necessary or appropriate to enforce and/or verify compliance with any part of these Terms of Use. You agree that Family Care Pharmacy has the right, without liability to you, to disclose any registration data and/or account information to law enforcement authorities, government officials, and/or a third party, as Family Care Pharmacy believes is reasonably necessary or appropriate to enforce and/or verify compliance with any part of these Terms of Use.
Nothing in these Terms of Use shall create or be deemed to create a partnership, agency, trust arrangement, fiduciary relationship, employment engagement, or joint venture between you and Family Care Pharmacy, its affiliates, or other users.
5. MISCELLANEOUS
A. FEEDBACK & INFORMATION
Family Care Pharmacy welcomes your feedback. Any feedback you provide through the Family Care Pharmacy Digital Services will be deemed non-confidential, and Family Care Pharmacy will be free to use such information on an unrestricted basis.
B. GENERAL INFORMATION
Family Care Pharmacy may elect to monitor areas of the Family Care Pharmacy Digital Services by electronic or other means and may disclose any Content, records, Submissions or electronic communication of any kind (i) to satisfy any law, regulation or government request; (ii) if such disclosure is necessary or appropriate to operate the Family Care Pharmacy Digital Services; or (iii) to protect our rights or property or the rights of the users, sponsors, providers, licensors or merchants. We are not responsible for screening, policing, editing or monitoring such Content. If notified of allegedly infringing, defamatory, damaging, illegal or offensive Content, we may investigate the allegation and determine in our sole discretion whether to remove or to request the removal of such Content from the Family Care Pharmacy Digital Services.
